1. Definitions and terms

Bazaaristanbul.eu – is the name of the online platform owned by SC CIHAN ENTERPRISE SRL, a legal entity of Romanian nationality, with its registered office in Baia Mare, with order number in the Trade Register J24/1221/2021, unique tax registration code 44606190 .

Seller – Any partner store registered in the Bazaaristanbul.eu platform

Buyer – natural person / legal entity or any legal entity that places an order within Bazaaristanbul.eu

• information related to the Goods and/or Services and/or the rates charged by a third party with whom the Seller has concluded partnership contracts, during a certain period;
• data related to the Seller, or other privileged data of the Seller.

Review – an evaluation written by the owner or beneficiary of a product or service, evaluation based on personal experience and his ability to make qualitative comments and to say whether or not the product or service complies with the specifications mentioned by the manufacturer.

Rating – way of expressing the degree of satisfaction of a Buyer vis-à-vis a product or seller. The rating is expressed in the form of stars, each product or seller being able to receive a score from one star to five stars. This degree of satisfaction will always be associated with the review written by the Buyer on a product, service or seller.

Document – these Terms and Conditions.

Newsletter – means of periodic information, exclusively electronic, respectively electronic mail (e-mail, SMS) about the Goods and Services and/or the promotions carried out by the Seller in a certain period, without any commitment from the Seller with reference to the information contained in this.

2. Your acceptance

2.1 This Document, through its content, makes available to third-party users the Regulation regarding the terms and conditions of use of the Bazaaristanbul.eu website.

4.6 Any uses that consist in the transmission of advertising materials or commercial messages to the users of the Site are prohibited;

4.7 Any action, activity, even through omission, that could facilitate or encourage actions that violate the Terms and conditions of use stated in this document or the applicable legal provisions for the legal performance of specific activities is prohibited;

4.8 In order to access and use certain sections of the Site, it may be necessary to create a personal account. Hereby, you declare that you assume full responsibility for any of the activities carried out through the account you open on the website and consequently we advise you to ensure the security of the account password or other access data. If the security of the account you own is compromised, you must immediately notify the site administrator. Bazaaristanbul.eu is not responsible for damages caused to you or caused to third parties of any kind by unauthorized use of the account.

6. Users of Bazaaristanbul.eu services and their status.

6.1 Any person can become a user of Bazaaristanbul.eu services if they have access to the Internet and after having co-confirmed acceptance of the terms by completing the process of creating the account or completing the order.

6.2 To complete the placing of an order, it is necessary to complete the order form, enter a valid email address and an Orange, Vodafone or Telekom mobile phone number and accept the commercial conditions imposed by the Seller.

6.3 The user undertakes to be the owner of the email address and phone number entered in the registration or order completion form. Also, the user must ensure that the contact data provided will be active.

6.4 The main purpose of Bazaaristanbul.eu Services is to regulate and coordinate the terms of sale-purchase transactions, as well as to facilitate the conclusion of transactions between Buyers and Sellers. Consequently, the services can only be used by persons who have full exercise capacity

6.5 If a Buyer places an order for an item subject to sale, he confirms that he has the legal right to buy that item. At the same time, the above does not refer to articles prohibited for sale-purchase or to those with a special regime.

6.6 Persons whose access to Bazaaristanbul.eu services have been suspended, restricted, withdrawn or prohibited for any reason, as well as persons who have in any way violated the provisions of the Terms and Conditions of Use, no longer have the right to use Bazaaristanbul.eu services .

6.7 Bazaaristanbul.eu reserves the right to close the Sellers’ access to the Bazaaristanbul.eu Seller account immediately and without any prior notice and to permanently delete the account and all data and information from it, in all cases where you violate in any way, or to any extent, and regardless of the reason, any of the above obligations, respectively any legal provisions or from the Bazaaristanbul.eu/Terms and conditions of use. All information and any contact data or personal data used for a closed or canceled account will be blocked, in the sense that they will not be able to be used in any way for any other account and any other registration on our website or for access to our services.

7. Rules for using the services provided by Bazaaristanbul.eu.

Seller’s Obligations

seller has the obligation to comply with the following rules:

7.1 Listing the items in the right category – The items must be listed in the right category. Ads that do not respect this rule can be moved to the appropriate category or deleted.

7.2 Multiple prices – Sellers are not allowed to enter a different price in the description of the products/services than the one written in the specially intended section, on the product/service page. Products that violate this rule may be deleted by Bazaaristanbul.eu.

7.3 Seller’s data – Sellers cannot provide their details such as phone number, e-mail address, when describing the products or services offered for sale, in the name of the store on the Bazaaristanbul.eu platform, or in the delivery details and payment of the item. Likewise, it is not allowed for a Seller to ask for contact details in messages to the Buyer.

Violations of the Listing Policy of products that contain such a description will either be edited or removed from the listing, they may lead to the temporary or permanent blocking of the account.

7.4 Defamatory information – The information provided in the title or description of the article, in the product reviews cannot be obscene, offensive, slanderous or violate the privacy of one of the parties.

Such articles can be deleted by Bazaaristanbul.eu and the account of the Seller who violates this rule can be temporarily or permanently suspended, according to Bazaaristanbul.eu’s own option, without the latter being obliged to justify, in any way or to any extent, the sanction Applied.

7.5 Manipulation of keywords – It is not allowed to insert keywords in the title of the product or service or in its description that are not directly related to the marketed product.

Ads that violate this rule can be edited/deleted by Bazaaristanbul.eu.

7.6 Promotion of the Seller – The Seller cannot advertise in his listing products or services of a third party, which are not related to the listed item.

Such articles will be considered violations of the Listing Policy and may be deleted by Bazaaristanbul.eu.

7.7 False description of the product – The description of the item must be consistent with its title and include the essential characteristics of the item to be sold. Articles that violate the Listing Policy may be deleted by Bazaaristanbul.eu.

7.8 The seller is not allowed to use any kind of referrals, including links to:

other sites that promote electronic commerce, sites that offer the same product, pay per click/view sites, outside the field in the user description online store intended specifically for the respective store link.

7.9 Free delivery – If a Seller offers free delivery for a certain product, this must apply regardless of the quantity purchased by the buyer. Articles that violate this rule may be removed from the listing.

7.10 Details of the minimum order and delivery – The seller has the obligation to enter all the details related to the minimum order and payment of the product’s transport in the specially designated sections from the store’s own account.

7.11 Taking orders from the Marketplace – A seller can take orders from the Marketplace common section only if the products that can be delivered are identical in terms of specifications and price to those in the initial order.

Obligations of the Buyer.

buyer has the obligation to comply with the following rules:

7.12 Provision of correct contact data – The buyer must enter correct and valid contact data when completing the order form, respectively mobile phone number and valid e-mail address, delivery address and contact person contact.

7.13 If the description of an item is not clear, the Buyer must ensure that this aspect is clarified before placing the order. Before placing an order, the Buyer can request additional information from the seller through the Contact Form on the product page where you are going to place the order.

By placing an order for a product/service, it is understood that you agree to buy it.

7.14 Honoring the order – When a buyer places an order, he undertakes to honor the order. If the seller brings concrete evidence to demonstrate the repeated non-pickup of parcels (return documents from the Romanian Post or courier companies) Bazaaristanbul.eu reserves the right to definitively block any future order of that Buyer.

7.15 Transfer of the order – When a buyer places an order within Bazaaristanbul.eu to a Seller and this order is canceled due to lack of stock, or the Seller is unable to complete the order for various reasons, the Buyer expresses his agreement that this order to be promoted for a period of 5 days to other Sellers within Bazaaristanbul.eu, who can honor the order.

8. Fees for services provided by Bazaaristanbul.eu.

8.1 Using the Services of the Bazaaristanbul.eu platform is free for Buyers but involves taxes and commissions for Sellers.

9. Bazaaristanbul.eu’s responsibilities towards the products presented

9.1 Bazaaristanbul.eu:

• does not guarantee in any way for the content appearing on the site, for the content offered by Sellers or other registered users.
• assumes absolutely no responsibility for any of the price changes appearing on the products displayed on the site and for any kind of damage or loss of profit.
• is not responsible for the content, quality or nature of the sites or products that are accessed through links on this site. The responsibility for these sites is entirely borne by the owners of the respective sites.
• is not responsible for user damages or other damages incurred when accessing the links provided. Bazaaristanbul.eu does not guarantee that product descriptions or other content appearing on the site are free of errors or that they are completely complete.
• does not guarantee and is not responsible in any way if the products purchased by the comparator do not correspond to the specific purposes for which they were purchased.
• is in no way responsible if there are inconsistencies or shortages regarding the products, their quality, or any other aspects regarding these products. Any complaint of the buyer will be brought to the Seller from whom the order was made at the time of receiving the products, following that they will be resolved by them within the legal term

10. Intellectual property rights
